Man says he plans to file lawsuit after he was attacked by a K-9, leaving him with 40 bite wounds all over his body, after his wife called 911 for a mental health crisis. Attorneys said the man was in the middle of a mental health crisis and his wife and stepson called to ask for an ambulance to pick him up. According to the family’s attorneys, the emergency call was not to police, but for an emergency ambulance response because the man was acting strange at home. Police nonetheless responded and classified it as a domestic disturbance call and said he became verbally and physically aggressive when they arrived at the home. His attorney said he lost 100 percent of his mobility and job opportunities because of the incident and plans to take legal action.
Unfortunately, the dispatchers flagged the report as a domestic violence call. In July 2021, Travis Maya’s wife, Kami, called 911 and reportedly told them that she was worried about her husband’s mental state. But, according to the family’s attorneys, the emergency call was not to police, but for an emergency ambulance response because the man was acting strange at home. The responding officers claimed that Moya was showing aggression and displaying his fists. Then they say he resisted arrest and tried to get away. Now, Travis says he plans to take legal action and file lawsuit against the police department. His wife, Kami, told CBS46 News that she and her husband still suffer from physical and emotional distress from that day.
11Alive reported that Moya’s wife made the call, which attorneys said was not to police, but for an emergency ambulance response. The whole incident was caught on camera. According to Travis, he was attacked by a K-9, leaving him with 40 bite wounds all over his body. The man also suffered a concussion. The responding officers said that they reportedly released the dog because he was aggressive. According to the police department, Moya started to take his jacket off and walked down the driveway in the direction of the K-9 officer with his fists closed. The video shows Moya walking with a jacket partially off when an officer pulls up. One of the responding officers then warned the man about the K-9, ABS reports. Police said an officer released the K-9 to get him under control and because he continued not to put his hands behind his back.
Kami Moya reportedly told 11alive: “It was terrifying to record my husband being attacked and trying to record and care at the same time. It was the most traumatic experience ever. There were pieces of his arm – he’s missing pieces of his arm.” Right after the incident, Travis was charged with felony obstruction for not complying with officer commands. Prosecutors dropped the charges on June 29, 2022.
Attorney Stewart said the charges were filed against Moya just to hide the bad behaviour of the officer involved in this situation. “We all saw from the video that Mr. Moya didn’t do a single thing in order to be charged and that he was the victim of excessive force. In these situations of excessive force, the easiest way to hide that is by creating these unnecessary and false charges against somebody. That’s the easiest way to hide bad behaviour.” Attorney Stewart reportedly said. Now, the family from Georgia want the police department to pay for the damage it has caused. His attorney said he lost 100 percent of his mobility and job opportunities because of the incident, WSBTV reports.
